OAU Saga: Court Dismisses No Case Submission by Adedoyin, others’ counsels

An High Court in Osogbo, Osun state on Wednesday has said the Owner of Hilton Honour Hotel, Abdulrahmon Adedoyin and seven others have case to answer in the alleged killing of Timothy Adegoke, the NBA student of Obafemi Awolowo University, OAU, Ile-Ife.

The court on Wednesday dismissed a “no case submission” filed by the counsels to all the defendants facing trial in the alleged killing of Timothy who was declared missing and later found dead after exhuming the body from a shallow grave along Ede road near OAU campus in ile-Ife.

The prosecution counsel, M.O Omosun had prayed the court that a no case submissiont by all the defendants be dismissed as prema facie had been established based on all evidences presented before the court.

In her ruling, Chief Judge of Osun, Justice Adepele Ojo considered all exhibits presented by all witnesses and admitted in evidence by the court, saying a prema facie, does not mean that the prosecution counsel must prove the case beyond reasonable doubt.

The judged said the prosecution was been able to established a prema facie through all the witnesses, that Timothy Adegoke lodged at the Hilton Honour Hotel, Ile-Ife and that his body was interfered with and disrespectfully evacuated.

She then discharged the “no case submission” filed by counsels to all the defendants and ordered that they enter their defence.

Responding to the ruling, one of the defence counsels, Kehinde Eleja, SAN, told the court that they were not ready to immediately file their defence since they were not sure of what the ruling.

He then prayed the court that the defence counsels would require time to prepare their defence.

Justice Ojo however adjorned till 25th of April, 2022 for the hearing of the defence.
